Legal Argument: Closing the Constitutional Lacuna on Criminal Record Disqualifications for Elected Officials Thesis: Under Canadian constitutional and administrative public law, the legal distinction between appointed state officers (Crown Attorneys, court clerks, members of the armed forces) and elected state officials (Mayors, MPPs, MPs, Premiers) regarding criminal convictions creates an unjustifiable, dangerous legal lacuna. Because elected representatives exercise primary, unmediated state authority—shaping legislation, directing public policy, supervising police/security boards, and accessing sensitive state information—they fulfill a fiduciary function at least equal to, if not exceeding, that of subordinate Crown agents. Therefore, an unpardoned criminal conviction should constitute a complete disqualification from seeking or holding elected public office. Click here. I. The Nature of the Legal Lacuna: Section 750 vs. Section 3 The Canadian legal framework currently exhibits a structural contradiction between Section 750 of the Criminal Code and Section 3 of the Canadian Charter of Rights and Freedoms: The Statutory Boundary (s. 750 Criminal Code): Under Section 750(1), any individual convicted of an indictable offence and sentenced to a term of imprisonment of two years or more automatically forfeits any public office or legislative seat. The Charter Inconsistency (s. 3 Charter): Following cases like Sauvé v. Canada (Chief Electoral Officer) [2002] 3 S.C.R. 519 and Harvey v. New Brunswick (Attorney General) [1996] 2 S.C.R. 876, courts have interpreted Section 3 broadly to protect the right of citizens to run for office once a prison sentence has expired. They should not be allowed to run at all and this is the only bar to being a candidate although all can seek or run for office except with that singular exception. The Lacuna: This framework creates an arbitrary temporal divide. The law recognizes that a criminal conviction destroys the capacity to exercise state authority while incarcerated, but falsely presumes that upon physical release, the moral and legal capacity to exercise the highest tier of state authority is automatically restored—even without a formal pardon or Record Suspension. If a crime damages public trust sufficiently to strip an individual of office on Day 1 of a sentence, that breach of trust does not magically evaporate on the day of release unless formally addressed through clemency channels. II. Indistinguishability of Authority: Crown Agents vs. Elected Officials The conventional legal defense of this divide relies on the fiction that elected representatives are merely "legislators" or "political representatives," while soldiers, police officers, court clerks, and Crown Attorneys are "executive agents." This distinction fails on three key legal grounds: 1. Exercise of State Power and Coercive Authority Subordinate agents (court clerks, Crown Prosecutors, military personnel) merely administer or execute laws drafted by elected officials. A Mayor, MPP, or MP exercises primary state authority: Mayors and municipal councils enact binding local by-laws backed by state coercion, fines, and land-use restrictions. MPPs and MPs enact criminal, civil, and regulatory statutes that govern liberty, property, and civil rights. MPs do not carry divine right. Citizens do not carry divine right that can be some how activated if they run for office. This is maybe what the confused thief of the legislature was looking for as he sought the attention of the whole world to also confirm if anyone was paying attention (He asked, "...Are you paying attention or are you busy with your bride.... your wife?") But, it is illegal and any Act that proports that some criminals can be involved in legislation and privy to sensitive Crown information is a fraud. A criminal is not even allowed to represent the Crown or access the building as a Court Security guard, cook or coffee server.
